- “Payment Instrument”: Includes credit card, debit card, bank account, prepaid payment instrument, UPI, IMPS, or any other payment methods introduced by banks or financial institutions.
- “Platform”: The website or platform where the Merchant offers its products or services and where the User initiates a Transaction.
- “Transaction”: Any order or request placed by the User to purchase products/services listed on the Platform by paying the Transaction Amount.
- “Transaction Amount”: The amount paid by the User for a Transaction.
- “User/Users”: Any person availing products and/or services on the Platform.
- “Website”: Refers to www.instamojo.com or the related mobile application.
3. MERCHANT’S RIGHTS
- You agree that we may collect, store, and share information provided by you for:
- Processing your order or service request
- Delivering products/services
Contacting you regarding your Transaction
4. YOUR RESPONSIBILITIES
You agree to provide true, complete, and updated information needed to complete a Transaction, including but not limited to:
- Name
- Email
- Phone number
- Delivery address
- Age
- Gender
Providing false or incomplete information may result in cancellation or delay of services.
5. PROHIBITED ACTIONS
As a User, you agree NOT to:
- Collect or compile data from the Platform without written permission.
- Use the Platform for unauthorized or illegal purposes.
- Create accounts using false information or automated methods.
- Circumvent or interfere with security features.
- Trick, defraud, or mislead the Merchant or other users.
- Misuse support services or submit false abuse reports.
- Use automation tools (robots, scripts, data mining tools).
- Interfere with Platform operations or network connection.
- Impersonate another person.
- Use information from the Platform to harass or harm others.
- Compete with the Platform or use its content for commercial gain.
- Reverse engineer any part of the Platform.
- Upload viruses, malware, or harmful code.
- Harass or threaten Merchant employees.
- Copy or adapt the Platform’s software or code.
- Engage in spamming or disruptive activities.
- Post harmful, insulting, or illegal content.
- Use the Platform in violation of applicable laws.
6. LIMITATION OF LIABILITY
If you receive a defective or incorrect product/service, your sole remedy is to initiate a refund request, subject to the refund policy.
The Merchant expressly disclaims liability for:
- Losses arising from product defects
- Payment failures
- Unauthorized transactions
- User error or negligence
- You agree to indemnify and hold the Merchant harmless from:
- Claims
- Damages
- Liabilities
- Costs arising out of your breach of these Terms
7. GUIDELINES FOR REVIEWS
When posting a review on the Platform:
You MUST:
- Have firsthand experience with the product/service.
- Provide honest and factual feedback.
You MUST NOT:
- Use offensive, abusive, or hateful language.
- Make discriminatory remarks (religion, gender, race, etc.).
- Reference illegal activities.
- Post misleading or false statements.
- Be connected to competitors when posting negative reviews.
Start campaigns to influence reviews.
We may accept, reject, or delete reviews at our discretion.
Reviews are user-generated content and do not reflect our views.
By posting a review, you grant us a worldwide, royalty-free, perpetual license to use, display, and distribute your review content.
8. GOVERNING LAW & DISPUTE RESOLUTION
- These Terms are governed by the laws of India.
- Courts in India have exclusive jurisdiction.
- Any dispute shall be resolved through arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996.
- A sole arbitrator will be appointed mutually within 30 days; otherwise, the Act’s procedures apply.
- Arbitration proceedings will be in English and kept confidential.
- Either party may seek injunctive relief from Bengaluru courts when necessary.
- Arbitration costs will be borne as per the arbitral award.
9. GRIEVANCE REDRESSAL
For queries or complaints related to:
- Products/services
- Double debit
- Fraudulent/unauthorized transactions
- Refund issues
You may reach out through the Platform’s grievance redressal link/contact.
10. DISCLAIMER
- By initiating a Transaction, you enter a legally binding contract to purchase the listed product/service.
- You must provide accurate payment details and use legitimate sources of funds.
- We may share your information with third parties for fraud verification or when required by law.
- We are not liable for unauthorized use of your Payment Instrument.
- All payments are at your own risk.
- We are not responsible for failed, declined, or erroneous transactions.
- You must keep your login details confidential.
- Platform content is for general information only and not advice.
- Third-party links are for information only and not endorsed by us.
- User-uploaded content is not verified or endorsed by us.
- We do not guarantee the Platform to be virus-free; users must use antivirus protection.
